Job Purpose

To serve as 1) the primary Labor and Employment Legal Counsel for Pearson K12 Learning, and 2) Pearson’s primary Subject Matter Expert on labor and employment law.

  • Provide legal support, services, guidance, and strategic advice regarding labor and employment law matters to all Pearson functions and businesses.

  • Maximize the consistency of Pearson’s policies, practices, and approaches, as much as possible given jurisdictional and cultural differences, in the Pearson business units, with regard to labor and employment law and related legal areas.

  • Manage outside counsel, where necessary, for labor and employment matters.

Key Accountabilities/Responsibilities

  1. Act as a key business partner, advisor, and counselor regarding labor and employment issues, to Pearson’s Human Resources team and Pearson management.

  2. Work closely as a business partner with the Company’s Risk, Compliance, Finance, and other operational units.

  3. Provide high quality, clear, relevant and business-centered legal support, service, and advice on all matters related to labor and employment law, and related legal areas, to the Human Resources function and to senior management. Including in particular:


Provide legal support, advice, strategy, and client counseling in legal compliance, and the prevention of potential claims and lawsuits, in the areas of termination of employment, unfair and wrongful dismissal, redundancy, employment agreements, employment discrimination, compensation, workplace diversity, independent contractors and contingent workers, employee benefits, payroll taxes, work/family issues, workplace safety, employee rights and workplace environment, unions and labor guilds, immigration, unemployment compensation, wage and hour issues, employee fraud and defalcations, employee confidentiality and conflicts of interest obligations, and all other employment issues;

  • Provide legal support in the investigation, defense, and/or resolution of employee claims, complaints, and legal actions in the areas of employment termination, unfair and wrongful dismissal, discrimination, harassment, breach of express and implied employment agreements, wage/hour, employee benefits, laws regarding employment of the disabled; Code of Conduct and ethics violations, and public policy;

  • Provide legal support in the drafting, interpretation, and implementation of company policies and practices related to labor and employment law and related areas, including redundancy and severance pay, ethical and conduct guidelines, and including those relating to the Pearson Code of Conduct;

  • Provide legal support to the process of investigating breaches of the Code of Conduct and allegations of corruption and criminal behavior by or related to Pearson employees;

  • Provide legal support for employment matters related to divestitures, acquisitions, mergers, and joint ventures, including drafting and negotiation of employment agreements and compensation arrangements for incoming executives and employees;

  • Provide legal support legal support in the drafting, interpretation, and implementation of employee and executive compensation plans;

  • Provide legal support for the employment aspects of the Company’s structural, organization, and cultural changes, including advising on strategic initiatives for reorganizations, and managing legal issues related to such reorganizations, such as reductions in force;

  • Provide legal support in the areas of labor and trade union and guild matters, including negotiation of collective bargaining agreements with unions, and dealing with unions and unionized labor forces; in jurisdictions where applicable, providing support, advice, and strategies with regard to union avoidance;

  • Provide legal support, services and advice on privacy and data security issues as they relate to employees;

  • Provide legal support, services and advice on claims and litigated matters, including selection, instruction, and liaising with external counsel as necessary. Occasional representation of Pearson before courts, agencies, or tribunals regarding labor and employment matters;

  • Provide legal training and education programs to management and employees relating to labor and employment matter and related areas of law, including Code of Conduct and ethics issues;

  • Provision of legal support on regulatory and government compliance matters as they relate to labor and employment issues, liaising with external advisers and regulatory bodies as necessary;

  • Provide legal support in the areas of immigration and non-immigration visas, H1-B, L-1, E-3, E-2, green card and other immigration processes and related immigration employment matters.

4.Ensure that legal services and advice related to labor and employment law, and related legal areas, are provided to a consistently high standard, and that legal services and advice are practical, creative, innovative, clear, commercially and strategically astute and results-oriented.

5.Reporting on all matters to, and working collaboratively with, the General Counsel, and working collaboratively with the other members of the Legal Function.

Knowledge & Skills

  • Qualified lawyer and member of the NY/NJ State bar preferred.

  • At least 5 years of experience in labor and employment law.

  • Thorough knowledge of labor and employment law concepts and ability to apply knowledge across multiple jurisdictions.

  • Experience with disciplinary and grievance procedures.

  • Address risks, new policy, and other needs arising from changing business models and technologies.

  • Assess intangible variables to identify and evaluate fundamental issues, providing strategy and direction for major functional areas.

  • Be honest and reliable, and act with utmost integrity.

  • Be collaborative.
